Welcome to Vi Ca Phe. These Terms of Service ("Terms") govern your use of our website and any orders placed with Vi Ca Phe ("we", "us", "our"), a sole trader business based in Birmingham, United Kingdom.

By placing an order or using our website, you agree to these Terms.

1. Our products

Vi Ca Phe sells freshly made Vietnamese-inspired coffee, tea, yogurt, and bottled beverages for delivery. All products are made fresh to order in small batches. Product descriptions, images, and prices are correct at the time of publishing but may change without notice; the price charged will always be the price shown at checkout.

2. Placing an order

When you place an order, you're making an offer to buy the products in your basket. Our minimum order value is £9.98. We'll send an order confirmation email once your order is received — this confirms we've received your order but does not guarantee availability. A contract is formed once we confirm your order has been accepted and is being prepared. Preparation typically begins almost immediately after an order is placed. You may also place a pre-order up to 5 days in advance of your chosen delivery date.

3. Delivery

All deliveries are carried out by our own in-house delivery team, not a third-party courier, within a 1-mile radius of B15 3DU, Birmingham, Monday to Friday, 7am–4pm, subject to our Shipping & Delivery Policy. Please allow up to 45 minutes' lead time for your order to be freshly prepared and delivered. Your driver will ask you to sign to confirm the number of drinks received; you must check your order and raise any issues with the driver immediately, at the point of delivery — see our Refund & Returns Policy for full details. Delivery times are estimates and not guaranteed; we are not liable for delays caused by circumstances outside our reasonable control.

4. Pricing and payment

All prices are listed in GBP (£). We are not currently VAT registered, so no VAT is added to our prices. Payment is taken at the time of order via the payment methods available at checkout. We use third-party payment processors (Shopify Payments and/or PayPal) to handle transactions securely; we do not store your full payment card details.

5. Cancellations, returns, and refunds

Please see our Refund & Returns Policy for full details. Once placed, an order cannot be cancelled, as preparation typically begins almost immediately. Pre-orders over £20 can be cancelled up to 2 days before the scheduled delivery date. Because our products are perishable and made to order, the standard 14-day right to cancel under the Consumer Contracts Regulations 2013 does not apply once production of your order has begun.

6. Allergens and food safety

Full allergen information for every product is listed in our Allergen Information below. Our kitchen handles milk, eggs, tree nuts, peanuts, and sesame, and we cannot guarantee any product is completely free from allergen traces due to shared preparation equipment. If you have a food allergy or intolerance, please check the allergen information for your chosen drinks or contact us at info@vicaphe.com before ordering.

7. Office and bulk orders

Bundle and office orders are subject to the same Terms as individual orders. Lead times for larger orders may be longer — see our Shipping & Delivery Policy.

8. Website use

You agree to use our website only for lawful purposes. You must not misuse our website by knowingly introducing viruses, attempting unauthorised access, or engaging in any activity that could damage or disrupt our services.

9. Intellectual property

All content on this website — including text, images, logos, and design — is owned by or licensed to Vi Ca Phe and may not be reproduced without our permission.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of our website or products. This does not affect your statutory rights as a consumer, including rights relating to faulty or misdescribed goods under the Consumer Rights Act 2015.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of our website after changes are posted constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
